MARY DEAN CALVIT HIGDON’S WILL

Be it remembered that I Mary Higdon of the County of Jefferson in the Mississippi Territory considering the uncertainty of this life and being of sound mind blessed be the almighty God for the same, do make and publish this my last will and testament, in manner and form following, that is to say FIRST, I will and direct that all my just debts be paid by my executor here in after named.
SECONDLY, I give and bequeath to my two sons Thomas Calvit and Joseph Calvit all my estate real and personal, to hold the same to their use of them to said Thomas and Joseph and the survivor of them, his heirs executors and administrators forever in trust nevertheless and to and for the uses intents and purposes whatsoever, that not to say, upon trust to permit my son Jeptha Higdon to take and receive to his own use the rents issues and profits my said estate during his natural life, but so that no part of my said estate shall in any wise be subject to the sale, disposition contracts or agreements of the said Jeptha, either past present or future. Nor in any wise subject to the payment of his debts. And from and immediately after the death of the said Jeptha upon future trust that the said Thomas and Joseph and the survivor of them, his heirs executors or administrators shall deliver to my grandson Jeptha Higdon Jr., son of the above name Jepha my negro man slave Petes and my negro slave Lucy with one sorrel mare now two years old and one black mare now six years old, 12 head of breeding meat cattle to hold the said negroes, mares, and cattle to the said Jeptha Jr. his executors and administrators in severalty [sic] forever and shall share and divide and deliver all the rest and residue of my estate in equal portions to and amongst all the children of my son Jeptha Higdon, the said Jeptha Jr included; to hold the same in _______to them their heirs executors and administrators forever.
And lastly I do nominate and appoint the said Thomas Calvit and Joseph Calvit to be executors of this my last will and testament; hereby revolking all other and former wills by me, herefore, at any time made.
In witness where of I have here unto set my hand and seal this 3rd day of August in the year of our Lord One Thousand Eight Hundred and Five.
